CoreDocket Terms of Use

1. Acceptance of Terms

By creating an account, accessing, or using CoreDocket (“Platform”), you agree to these Terms of Use (“Terms”). If you do not agree, you must not use the Platform.

This Platform is operated by Peak Productive Consulting Pty Ltd trading as CoreDocket (“CoreDocket”, “we”, “us”, or “our”). By using the Platform, you confirm you have read, understood, and agree to be bound by these Terms. If you use the Platform on behalf of a business or other legal entity, you warrant that you have authority to bind that entity.

2. Nature of the Service

CoreDocket is a cloud-based workflow and operational data capture software tool designed to assist businesses with job management, field records, labour tracking, plant and materials tracking, photo capture, customer approvals, signatures, reporting, and draft invoice generation.

The Platform is a tool only and does not:

  • verify or validate any data entered by users;
  • act as a system of record;
  • provide legal, financial, accounting, engineering, or compliance services.

All outputs are generated from user-supplied data and must be independently verified before reliance. CoreDocket may modify, suspend, or discontinue any feature at any time without liability.

3. User Accounts

You are responsible for:

  • maintaining the confidentiality of login credentials;
  • all activity conducted under your account;
  • ensuring account information is accurate and up to date;
  • notifying CoreDocket of any unauthorised access.

Account sharing is not permitted unless expressly allowed under your subscription.

4. Customer Data

You retain ownership of all data, documents, images, signatures, records, and content uploaded to the Platform (“Customer Data”).

You grant CoreDocket a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and back up Customer Data solely for operating the Platform and providing services. CoreDocket does not claim ownership of Customer Data.

Our obligations when handling Customer Data on your behalf — security, confidentiality, sub-processors, breach notification, and returning or deleting it — are set out in the Data Processing Terms, which form part of these Terms.

5. Data Responsibility

You are solely responsible for:

  • accuracy, completeness, and legality of Customer Data;
  • ensuring Customer Data is suitable for invoicing, reporting, payroll, or compliance purposes;
  • obtaining all required consents and authorisations;
  • maintaining independent backups of important records.

CoreDocket has no obligation to verify, audit, or correct Customer Data.

6. System Outputs, Draft Invoices and No Reliance

The Platform may generate draft invoices, reports, calculations, timestamps, GPS data, job records, summaries, and other outputs based on user input. You acknowledge and agree that:

  • all outputs are automated and based solely on user-entered data;
  • outputs are operational estimates only and are not verified or certified by CoreDocket;
  • CoreDocket does not warrant the accuracy, completeness, or suitability of any output.

You are solely responsible for reviewing and verifying all outputs before use or reliance. To the maximum extent permitted by law, CoreDocket is not liable for incorrect invoices, billing errors, undercharging, overcharging, payment disputes, or reliance on system outputs in any dispute or proceeding.

7. Site Records and Evidentiary Disclaimer

The Platform may capture signatures, photographs, GPS data, timestamps, notes, and job records. These records are user-generated or system-assisted only, are not independently verified, and are not certified records of truth.

CoreDocket does not guarantee legal admissibility, accuracy, completeness, or acceptance in legal, arbitration, insurance, or payment disputes. You agree not to rely on Platform records as conclusive evidence of work performed, approvals, variations, or contractual compliance.

8. Compliance With Laws

You are solely responsible for compliance with all applicable laws, including taxation and GST, employment and payroll laws, workplace health and safety laws, privacy laws, building and construction regulations, record-keeping obligations, and consumer protection laws. CoreDocket does not provide legal, accounting, financial, or compliance advice.

9. Communications and Consent

If you use communication features within the Platform (including SMS, email, or notifications), you warrant that you have obtained all necessary consents required under applicable law (including the Spam Act 2003 (Cth)) and that you maintain accurate and auditable consent records. You indemnify CoreDocket for any claims arising from communications sent through your account.

10. No Professional Advice

The Platform is a software tool only. Any outputs, reports, calculations, or summaries are provided for convenience only and do not constitute professional advice of any kind. You must obtain independent professional advice before relying on any output.

11. Intellectual Property and Anti-Replication

All intellectual property rights in the Platform, including software, source code, design, workflows, UI/UX, documentation, and branding, remain the exclusive property of CoreDocket.

You must not:

  • copy, reproduce, or modify the Platform;
  • reverse engineer, decompile, or attempt to extract source code;
  • replicate, mimic, or recreate the Platform's workflows, UI/UX, feature logic, or system behaviour;
  • develop or assist in developing any substantially similar competing product using knowledge derived from the Platform;
  • perform competitive benchmarking or system analysis for commercial replication purposes.

12. Subscription Fees

Trial. Where a free trial is offered, it runs for the period stated when you sign up and no payment details are required to start it. At the end of the trial you are not charged automatically: the account continues only if you choose a plan.

Subscription. Subscriptions are billed monthly in advance at the fees shown to you when you subscribe, and renew each month until cancelled. Fees are quoted exclusive of GST, which is added at checkout.

Seats. Fees are based on the number of people with a login to your account. Adding someone during a billing period is charged pro rata at the time you add them. Removing someone takes effect at the end of the current billing period and is not credited or refunded — the seat remains available to you until then.

Changes to fees. We may change our fees, and will give you at least 30 days’ notice by email or in the app before a change applies to your account. If you do not accept the new fees you may cancel before they take effect.

Cancelling. You may cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period and you keep access until then. Fees already paid are non-refundable except where required by law, including the Australian Consumer Law.

Non-payment. If payment is not received when due we may restrict access as described in clause 13.

13. Data Retention and Access

Access to Customer Data is not withheld to secure payment. Where an account is overdue or suspended, CoreDocket may restrict the office functions of the Platform, including the creation and editing of jobs, quotes, invoices and schedules. Reading and exporting Customer Data remains available, and work already in progress in the field application is not interrupted. No Customer Data is deleted by reason of non-payment.

After an account closes. Customer Data is retained for 90 days so that it can still be retrieved, and is then deleted or de-identified. You may ask us to delete it sooner, subject to anything we are required to keep by law.

14. Fair Use

Where unlimited usage is provided, it is subject to fair and reasonable use. CoreDocket may limit usage that materially impacts system performance, exceeds normal operational patterns, or threatens platform stability or security.

15. Third-Party Services

CoreDocket may integrate with third-party services. CoreDocket is not responsible for third-party outages, data loss or corruption in third-party systems, or integration failures. Your use of third-party services is subject to their terms.

16. Service Availability

The Platform is provided on an “as is” and “as available” basis. CoreDocket does not guarantee uninterrupted, timely, secure, or error-free operation. No service level agreement applies unless separately agreed in writing.

17. Limitation of Liability

To the maximum extent permitted by law, CoreDocket excludes all implied warranties and is not liable for indirect, incidental, or consequential loss, or loss of profit, revenue, business, data, or contracts. CoreDocket's total liability is limited to fees paid in the 12 months preceding the event giving rise to the claim.

18. Indemnity

You agree to indemnify CoreDocket against any claim, loss, liability, damage, or expense arising from your use of the Platform, Customer Data, invoices or outputs generated, communications sent through the Platform, or disputes involving your customers, employees, contractors, or third parties.

19. Australian Consumer Law

Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded. Where permitted, liability is limited to the maximum extent allowed by law.

20. Suspension and Termination

CoreDocket may suspend or terminate access if fees are unpaid, you breach these Terms, security risks are detected, or unlawful or abusive conduct occurs. Suspension for unpaid fees works as described in clause 13 and leaves your data readable and exportable. Suspension for a security risk or for unlawful conduct may be immediate. CoreDocket is not liable for any resulting loss.

21. Force Majeure

CoreDocket is not liable for delays or failures caused by events outside its reasonable control, including outages, cyber incidents, disasters, or third-party failures.

22. Governing Law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.

23. Entire Agreement

These Terms constitute the entire agreement between you and CoreDocket and supersede prior agreements or understandings.
